My lawyer told me that another attorney told him that if I was in default before I filed bankruptcy that they may consider student loan consolidation. he also said, that if I wasn't in default when I filed they will not consider loan consolidation. Please let me know if this is accurate and where can I get more information on student loan consolidation.
You can consider student loan consolidation before filing.
Go and talk to the loan company about this and ask for their assistance.
Bankruptcy will discharge your student loan obligation.
Student loans are generally not able to be discharged in bankruptcy.
Regardless of whether you file bankruptcy or not, you have options available if these are Federal student loans, and not too many options available if they are Private student loans.
I am not an attorney, and you should not be "checking" your own attorney's advice against what complete total strangers say, who may or may not be who or what they say they are, on the internet.
I would strongly urge you to get a second legal opinion in person from a licensed attorney experienced in bankruptcy matters and eligible to practice law in your state. What you report your attorney having said does not sound correct to me ? BUT AGAIN (a) I am not an attorney, and (b) you should not be "checking" your attorney's advice against the opinions of total strangers on the Internet anyway.
Additional Info: Your attorney may be able to write a Ch 13 Plan under which you do not pay student loan payments at all during your Ch 13. It has been done. I have seen it. But be VERY careful about this option, since your student loans WILL keep accruing interest during your bankruptcy, and at the end of the bankruptcy you will wind up owing almost twice as much as you do now in student loans because of the added interest.
