Analysis: Why Roberts saved Obama's healthcare law

WASHINGTON (Reuters) - In the end, it all came down to Chief Justice John Roberts, the sphinx in the center chair, who in a stunning decision wove together competing rationales to uphold President Barack Obama's healthcare plan.

Roberts' action instantly upended the conventional wisdom that he would vote with his four fellow conservative justices on the U.S. Supreme Court and undercut the agenda of a Democratic president, who as a senator in 2005 had opposed Roberts' appointment to the bench.

But Thursday's extraordinary conclusion to the bitterly fought healthcare battle was quite ordinary in some ways. Roberts hewed to a traditional Supreme Court principle that if the justices can find any constitutional grounds on which to uphold a law, they should do so. The 57-year-old chief justice also followed a stated principle of his own: narrowly deciding cases and trying to preserve the integrity of the judiciary in polarized Washington.

While he has voted consistently with the conservative bloc on social issues, such as abortion rights and racial policies, Roberts in his public remarks has suggested that he seeks, as chief, to transcend an ideological label. He routinely refers to the court's place in history and has bristled at polls and public commentary that suggest the high court acts in the same political realm as the two elected branches of government.

Indeed, in his comments during oral arguments in the healthcare case, Roberts hinted that he could be open to siding with the government. He expressed concern that the court over which he presides might be seen as ignoring more than 75 years of precedent and rolling back U.S. law to the New Deal era. The last time the Supreme Court struck down a major act of Congress was in 1936, when the court invalidated a federal law that limited work hours and prescribed minimum wages for coal workers.

"He is positioning the court as the one, competent, principled institution in Washington," said Pamela Karlan, a Stanford University law professor. "The chief justice's opinion is designed to appear thoughtful, measured. He is in this for the long haul."

DEFYING HISTORY

As the lone conservative standing with four liberals, Roberts defied recent history, most people's expectations, and the deepest held hopes of the right-wing and Tea Party opponents of the law. He also rejected the prevailing view of Republican politicians, who had been his strongest backers when President George W. Bush nominated him five years ago.

"The court avoided, despite an enormous amount of pressure to invalidate this law, staining itself as excessively partisan," said Bradley Joondeph, a law professor at Santa Clara University. "Think of the people who supported Chief Justice Roberts, who put him on the court, who were rooting for him."

On the Roberts court, the swing-vote role has often been played by Justice Anthony Kennedy, not the chief himself. For example, Kennedy, a conservative appointed to the court by President Ronald Reagan in 1988, was crucial to its 1992 decision to uphold the right to abortion. Thursday's case marked the first time that Roberts joined the liberal bloc as the deciding fifth vote in a major case.

On Thursday, Kennedy fell in with the conservatives and read their joint dissent. In it, he took a swipe at Roberts' claim that the court was acting cautiously. "The court regards its strained statutory interpretation as judicial modesty," Kennedy wrote. "It is not. It amounts instead to a vast judicial overreaching."

A PYRRHIC VICTORY

Roberts did hand the conservatives a pyrrhic victory. He rejected the Obama administration's main argument that the core of the law, a mandate that requires most Americans to buy health insurance by 2014 or face a penalty, was covered by Congress's power to regulate interstate commerce. Roberts said that power, while broad, does not extend to "inactivity," such as the choice not to buy insurance.

Whether this apparent limiting of the Commerce Clause will hinder Congressional power in the future remains to be seen. In their briefs and arguments, both sides characterized the health insurance mandate as distinctive, and it is unclear whether another Congressional regulation could be struck down under the Roberts "inactivity" rationale. Roberts' judgment on the Commerce Clause issue was endorsed by fellow conservatives Kennedy, Antonin Scalia, Samuel Alito and Clarence Thomas.

But in turning to another constitutional ground on which to uphold the mandate, Congress' taxation power, Roberts embraced the Obama administration's secondary argument - and delivered a victory to the President. Roberts reasoned that even though Congress had shied away from calling the penalty for not buying insurance a "tax," it effectively is one.

Roberts stressed that the court was not endorsing the administration's approach. "Because the Constitution permits such a tax, it is not our role to forbid it, or to pass on its wisdom or fairness," he said.

As he read excerpts from the momentous decision Thursday, Roberts seemed to downplay the drama of the morning. His voice was steady and even. He kept to his script. There were few rhetorical flourishes. He occasionally looked out at the spectators. Among them was Justice John Paul Stevens, a liberal who had served with Roberts until he retired two years ago at the age of 90.

Following the usual decorum in the white-marble and crimson-draped room, the nearly 300 people listening to the chief justice gave no audible response. Roberts then named the justices who had joined him in various parts of the decision, and those who had not. All told, it took about 20 minutes.

Using customer feedback to give location-specific, actionable insight ...

Online restaurant reviews have been skyrocketing in their popularity and influence and there is no slow-down in sight. An estimated 129 million consumers are talking about restaurants on social networks daily and that number is expected to swell to 220 million by 2015.

With social media providing a ready platform for one?s voice to be heard, diners are jumping online to share their opinions and evaluate their experiences. And their peers are listening. It is estimated that 82 percent of customers will use their smartphone to read online content when finding and selecting a restaurants in 2013. And, they?re flocking to sites such as Yelp, UrbanSpoon, Facebook, and Twitter to tap into the wisdom of the crowd to help them make their dining choices.

Despite the concerns regarding content credibility, most in the industry agree the better experience you provide, the better your rating and online reputation on these sites. Just as important, the better your online reputation, the more revenue you generate.

Gleaning location-specific insight from these online conversations is the key to driving the coveted positive reviews. By reading and understanding credible mentions online and translating it into location-specific data, restaurant executives can listen to and understand the real issues that impact the local customer experience and earn their continuous loyalty.

For instance, during a monthly review of their comment dashboard, a midscale restaurant?s management team member identified a negative trend in comments about the Chicken Caesar Salad at a particular location. Filtering the data by day part, they determined that most of the negative commentary attributed to the salad was during lunch service. Management retrained the lunch shift responsible for Chicken Caesar Salad food prep and effectively addressed the root source of the guest satisfaction issue: too much dressing. Negative commentary about the salad declined post retraining, positive elements of the dish shined, and unit sales increased over the month after the operational change.

Another restaurant group was able to glean similar operational insight. Reviewing the dashboards, management found a critical mass of mentions online warning potential guests that the restaurant had a slippery floor, particularly for women wearing heels. When drilling into the themes in feedback, management found that the issue was focused to one?specific?part of the restaurant: a high traffic area, on a turn from the restrooms, close to the food and beverage service area, and where airborne grease likely travels. The fix was simple enough: The restaurant now uses a longer mat in that area for an incremental charge of $5/week (they were already renting a mat in front of the area, but was not big enough to cover this area per customer feedback), and they also added this portion of the restaurant as part of a regular management inspection. Since making these slight changes, there have been no more mentions online about the floor being slippery ? thereby avoiding potential guest?embarrassment as well as slip and fall legal issues.

As these examples illustrate, listening to customer conversations and gleaning location-specific operational insight from this feedback enables restaurant organizations to ensure they are delivering a quality customer experience at each and every outlet. With consumers increasingly hopping on their smart phones to geo-locate and evaluate restaurants, arming yourself with location-specific intelligence has never been more important.

(AP) ? A producer of Nora Ephron's new play, "Lucky Guy," says he is "committed" to getting her biography of a newspaper columnist on a Broadway stage despite the death this week of the playwright.

Colin Callender said Thursday that his team "can think of no more fitting tribute to her extraordinary writing and remarkable body of work" than to proceed with plans to produce Ephron's play.

"We are honored to be part of her legacy and remain committed to seeing her magnificent work 'Lucky Guy' shine on Broadway," Callender said in a statement.

"Lucky Guy" follows the story of tabloid reporter Mike McAlary, who won a Pulitzer Prize in 1998 for his coverage on the New York City police brutalization of Abner Louima. McAlary died that same year of colon cancer at age 41.

When word of the potential production first surfaced this spring, Tom Hanks was reported to be in negotiations to play McAlary next year on stage.

Ephron, who died Tuesday in New York City at age 71, gained recognition as the writer of films such as "When Harry Met Sally" and "Sleepless in Seattle." She made her playwriting debut in 2002 with "Imaginary Friends" and co-wrote 2008's off-Broadway play adopted from the book "Love, Loss, and What I Wore."

Callender is the former head of HBO Films, who oversaw such acclaimed mini-series and original movies as "John Adams," ''The Pacific," ''Empire Falls" and "Recount." In 2010, Callender formed his own Beverly Hills-based film, television and theater production company, Playground Entertainment.

US unemployment aid applications fall to 386,000

(AP) ? The number of people seeking U.S. unemployment benefits fell last week, but the level of applications remains too high to signal a pickup in hiring.

The Labor Department said Thursday that weekly applications fell to a seasonally adjusted 386,000. That's down from 392,000 the previous week, which was revised up. The four-week average, which smooths week-to-week fluctuations, was mostly unchanged at 386,750.

"Jobless claims are still too high and show that employment growth is slowing and no progress is being made," said Jennifer Lee, an economist at BMO Capital Markets.

Separately, the Commerce Department said the expanded at a 1.9 percent annual rate in the first three months of the year. The third and final estimate for growth in the January-March quarter was unchanged from the government's previous estimate.

Most economists say growth has likely stayed roughly the same or possibly weakened since then. A sluggish job market and diminished consumer and business confidence have kept the economy from accelerating in the April-June quarter.

Weekly unemployment applications are a measure of the pace of layoffs. When applications rise above 375,000, it generally means that hiring isn't strong enough to rapidly lower the unemployment rate.

Applications fell steadily over the winter, and monthly job gains soared. But since then applications have edged up and hiring has slowed, raising concerns about the recovery.

Employers added an average of only 73,000 jobs per month in April and May. That's much lower than the average of 226,000 added in the first three months of this year.

The unemployment rate increased to 8.2 percent in May, up from 8.1 percent in April.

The number of people continuing to receive benefits, meanwhile, rose to 5.9 million in the week ended June 9, the latest data available. That's about 70,000 more than the previous week.

Other recent indicators have painted a mixed picture of the economy.

A closely watched private survey released this week showed consumer confidence fell in June for the fourth straight month. The Conference Board said worries about the job market outweighed lower gas prices and steady improvement in the housing market.

And U.S. manufacturing activity, which has helped drive growth since the recession ended three years ago, has weakened. Factories produced less in May than April, the Federal Reserve said this month. Automakers cut back on output for the first time in six months. In June, manufacturing activity barely grew in the New York region and contracted sharply in the Philadelphia area, according to surveys by regional Federal Reserve banks.

Also affecting the U.S. economy is Europe's debt crisis, which has dampened demand for American exports. And consumers barely increased their retail spending in April and May.

But there have been hopeful signs.

U.S. factories received more orders for long-lasting manufactured goods in May, while a key measure of business investment plans rose.

And the housing market is looking a little better. Home sales are up from last year, home prices are rising in most cities and homebuilders are planning to break ground on more projects in the next 12 months.

Still, the Federal Reserve has cut its forecast for the year. It now expects growth of just 1.9 percent to 2.4 percent for 2012. That's half a percentage point lower than the range it estimated in April. The Fed also says unemployment won't fall much further this year than it has.

Stowaways possible in container ship docked in N.J.

NEWARK, N.J. (AP) ? Dock workers unloaded stacked containers from a cargo ship that arrived in New Jersey from the Middle East after a Coast Guard inspection team heard knocking that suggested stowaways might be inside one of the boxes.

The 850-foot Ville D'Aquarius was met by law enforcement officials and more than a dozen ambulances when it docked early Wednesday at Port Newark, one of the nation's busiest ports. Large mechanical cranes began unloading containers from the ship.

By evening, officials had inspected more than 150 of the 200 containers authorities believe could be carrying people and no stowaways had been found. The search was to continue on Thursday. The ship has 2,000 containers altogether.

"If there are people down there, with no food and water for days, they're probably pretty desperate by now," said Drew Barry, of the Sandy Hook Pilots Association, who boarded the vessel about 20 miles offshore to help pilot it into port.

The Coast Guard team had boarded the ship outside New York Harbor early Wednesday as the ship prepared to dock, spokesman Charles Rowe said. The officers were knocking on a bulkhead, or partition, of the ship as a routine security check and heard knocks back, he said, but they couldn't pinpoint the source of the sound. The return knocks ended after about two hours, Rowe said.

The team followed protocol and didn't open containers at sea in order to control the situation, he said.

Shipping containers are steel boxes, usually 8 feet wide and 8- to 10-feet high and either 20- or 40-feet long, designed to withstand the rigors of the high seas and are strong enough to be stacked several high.

They normally can be opened only from the outside. There's hardly any ventilation.

Rowe said it was taking about eight minutes to check each container ? unloading it off the ship, opening it up and X-raying it if necessary.

The Department of Homeland Security, which was also involved in the investigation, said Wednesday night that its officers and agents were prepared to continue examining containers through the night.

The container ship, which a manifest said was carrying machine parts to Norfolk, Va., was loaded in India, Rowe said.

The ship began its voyage May 30 in the United Arab Emirates, then made one stop in Pakistan and two stops in India. Its last port before Newark was in Egypt on June 15.

Speaking at an unrelated news conference, Andrew McLees, special agent in charge of Homeland Security investigations for U.S. Immigration and Customs Enforcement, said the ship's origin and itinerary prompted the initial search.

"The routing of the ship and the ports of call was what led to the actions," McLees said.

Michael Ward, the FBI's top official in New Jersey, said the response was appropriate given the port's vulnerability. The area is considered a prime potential target for terrorists.

"You're going to get a response like this any time you have these types of facts," Ward said. "It was an appropriate response which we did out of an abundance of caution."

Shipping companies are legally responsible for keeping stowaways off their vessels, said Frank Atcheson, a maritime lawyer based in North Bergen, N.J. When stowaways are found, the companies are liable not only for fines but also must pay to house the stowaways where they are found and for secure transportation back to where they originated.

Between January 1998 and Dec. 16, 2011, more than 13,000 stowaways were found in more than 4,000 incidents around the world, according to the International Maritime Organization.

Giants closing in on Dodgers in NL West

SAN FRANCISCO (AP) - Ryan Vogelsong picked up where Barry Zito left off and the San Francisco Giants had the Los Angeles Dodgers once again searching for answers and runs.

Vogelsong pitched seven innings to outduel San Francisco nemesis Clayton Kershaw for the second time this season and Melky Cabrera homered to help the Giants move within a game of Los Angeles for first place in the NL West with a 2-0 victory Tuesday night.

Vogelsong (7-3) followed Zito's seven innings in Monday's 8-0 win in the series opener with his own gem, marking the first time the Dodgers had been blanked in consecutive games in San Francisco since 1987 and for the second time ever.

"It's hard to do, especially against a good club," Giants manager Bruce Bochy said. "Our pitching has been right on in this series. Vogey was tough today, good stuff, good command."

Cabrera's leadoff homer in the fourth snapped Kershaw's streak of 35 2-3 consecutive innings in San Francisco without allowing an earned run to the delight of the sellout crowd chanting "BEAT L-A! BEAT L-A!" all night. Pablo Sandoval added an RBI single for the Giants, who haven't been this close to first place since after the first day of the season.

Kershaw (5-4) allowed two runs and eight hits in six innings but got no support from the Dodgers' struggling hitters who sorely miss injured slugger Matt Kemp.

Los Angeles has dropped seven of eight on a nine-game California road trip that concludes Wednesday against the Giants, getting outscored 35-13 in the process.

"You get shut out a couple days and there's frustration," Dodgers manager Don Mattingly said. "That's natural. It's my job to make sure we keep going."

Kershaw had won six straight decisions against the Giants, allowing earned runs in just two of those seven outings before falling 2-1 at home on May 8 when Brett Pill hit a two-run homer and Vogelsong shut down the Dodgers for 7 1-3 innings.

San Francisco used a similar formula to get to the reigning NL Cy Young winner in this game with Cabrera providing the power and Vogelsong once again delivering a stellar start.

"I feel like I have something to prove every game," Vogelsong said. "Just because I came out on the right side in two games with him that doesn't change. But it's definitely a step in the right direction."

As stingy as Kershaw has been in his career in San Francisco, Vogelsong has been almost as tough. He allowed seven hits and lowered his home ERA to 1.85 in his two seasons with the Giants, second to only to the Angels' Jered Weaver (1.55) in that span.

Jeremy Affeldt pitched a perfect eighth and Santiago Casilla finished for his 21st save in 23 chances.

Kershaw had struck out four in setting down the Giants for the first three innings. That all started to change on the second pitch of the fourth inning when Cabrera sent a drive that just cleared the wall in left-center for the first homer Kershaw had allowed in seven appearances in San Francisco.

The Giants didn't stop there, getting three more hits in the inning with Sandoval adding an RBI single before Kershaw escaped a bases-loaded jam by striking out Vogelsong and Gregor Blanco to end the inning.

"Tonight I blinked first and it cost us," Kershaw said. "I think we are frustrated but we have to take that anger and aggression to the field and keep coming every day. It doesn't matter who we're playing if we're not winning games. We just have to start playing better baseball."

Kershaw pitched out of trouble again in the fifth, surviving a line drive off his leg by Buster Posey, but it turned out not to matter the way Vogelsong handled the Dodgers hitters.

"We figured this would be a low-scoring game," Bochy said. "We found a way to get a couple of runs against a pitcher who has been hard on us. That's the only way we beat him a couple of times. Score a couple of runs and get a well-pitched game."

Tropical Storm Debby Trains Sights On Florida, Alabama

MIAMI ? Slow-moving Tropical Storm Debby's outer bands lashed Florida with rain and kicked up rough surf off Alabama on Sunday, prompting warnings for those states and causing at least one death.

The death in Florida was blamed on a tornado spawned by the storm, while a man went missing in the Gulf at an Alabama beach.

Underscoring the storm's unpredictable nature, forecasters discontinued a tropical storm warning for Louisiana after forecast models indicated Debby was less likely to make a westward turn than initially predicted. Coastal Alabama and parts of Florida, including the Panhandle, remained under tropical storm warnings.

Debby already has dumped heavy rain on parts of Florida and spawned some isolated tornadoes, causing damage to homes and knocking down power lines. High winds forced the closure of an interstate bridge that spans Tampa Bay and links St. Petersburg with areas to the southeast.

Storm tracks are difficult to predict days in advance. But as of late Sunday the latest forecast map shows the center of the storm 100 miles (165 km) south-southwest of Apalachicola, Fla., and likely to meander northward for several days before making landfall.

Chris Landsea, a meteorologist at the National Hurricane Center, said forecasters rely on computer models which were contradictory until Sunday.

"They came into a bit more of an agreement that the westward turn is less likely," he said.

Landsea said every storm is different and has different characteristics, "and in this case it's a very unpredictable storm." He said Debby could become a hurricane.

A major concern will be flooding from heavy rainfall. The storm is moving slowly, allowing its clouds more time to unload rain. A public advisory said parts of Florida and southeast Georgia could receive 5 to 10 inches of rain, with some areas getting as much as 20.

Debby's top sustained winds were at about 60 mph (95 kph). The storm was moving toward the northeast at 3 mph (6 kph).

The Highlands County Sheriff's Office said in a news release that several tornadoes moved through the area southeast of Tampa, damaging homes.

Sheriff's Office spokeswoman Nell Hays said a woman was found dead in a house in Venus that was destroyed in the storm. A child found in the same house was taken to the hospital. No further information was available on the child's condition or either person's age.

"This is quite common with this type of storm," senior hurricane specialist Stacy Stewart with the National Hurricane Center said of the twisters. "They tend to not be very large or long-lived, which can be difficult to detect on radar. So people need to keep an eye on the sky."

In Orange Beach, Ala., a 32-year-old man went missing Sunday in rough surf kicked up by the storm, said Coast Guard Lt. j.g. Torry James. Further information wasn't immediately available.

Near the mouth of the Mississippi southeast of New Orleans, Plaquemines Parish President Billy Nungesser said officials were making preparations to protect the main highway from tidal flooding. Louisiana Gov. Bobby Jindal also declared a state of emergency to make it easier to send supplies and workers to areas that may need it.

However, despite warnings in the Panhandle, Debby hadn't totally dampened vacations.

Thousands were on the beach at Pensacola Beach, Fla., on Sunday morning. Many used their phones to take photos of huge waves crashing into the concrete supports of a fishing pier. There wasn't any rain yet; just gusty winds and dark, fast-moving clouds.

Few people were in the water. Red flags warned tourists to stay out of the surf, and lifeguards cruised the sand on all-terrain vehicles, blowing whistles at anyone who got near the waves.

Workers from rental companies used pickup trucks to gather chairs and umbrellas as a precaution against an unusually high tide.

As of Sunday morning, 23 percent of oil and gas production in the region had been suspended, according to a government hurricane response team. Employees have been evacuated from 13 drilling rigs and 61 production platforms in the Gulf of Mexico.

Though these can be battery and processor hogs, they can give your phone the "wow" factor that many people are looking for. I've tried Live Wallpapers on a Motorola Droid, HTC Incredible and on a Samsung Fascinate. While the Samsung manages the Live Wallpapers well and has some very interesting choices, I found that the stock Live Wallpapers for the HTC and Motorola were a bit bland. The process involved in changing your wallpaper are very simple and take just a few steps.

  1. Press your Menu key- This will bring up a list of options that will include a shortcut labeled "Wallpaper."
  2. Tap Wallpaper -Your screen will show the three wallpaper options you have to choose from.
  3. Choose from? Gallery, Live Wallpapers or Wallpaper. -Selecting each option will bring you to the available images under each choice. Choosing "Gallery" will bring you to your saved images and photographs.
  4. Tap the? Set Wallpaper? button once you decide on your new wallpaper.

Once you set your wallpaper, you will be brought back to the main screen where you will be able to admire your new, customized look of your Android smartphone's appearance. If you want to add your special touch to your phone?s appearance, click the Menu button and select Wallpaper. You will have the option of animated images under the Live Wallpaper options, regular stock wallpaper, or any picture in your gallery.

To find a practically unlimited number of wallpapers, do a search on the Android Market for wallpapers. There are several free apps available for download that will give you access to thousands of free wallpapers.

Four killed after light plane crashes in Oregon

A small plane crashed soon after taking off from a private airstrip in Oregon timber country Saturday and killed all four people on board, authorities said.?

The small plane went down around 3:10 p.m. in a rural area west of Eugene, according to the Lane County Sheriff's Office.


Citing witness reports, authorities said the plane began to lose altitude shortly after take-off and hit a large tree that Lane County District No. 1 Fire Chief Terry Ney said tore off a wing of the aircraft.?

The single-engine Cessna landed upside down, Ney said. Fire authorities pronounced the four people inside the aircraft dead at the scene.?

Details about the victims and their names were being held pending notification of next of kin.?

The National Transportation Safety Board was en route Saturday to investigate the crash while the sheriff's office helped secure the scene.?

Lane County records show the airstrip where the plane took off is owned by Conrad Magnuson and known as Crow-Mag Airport, according to a report by Mark Baker in the Eugene Register-Guard.

The newspaper said Magnuson declined to be interviewed when approached at his home.

??It?s going to take heavy tools to get them out of there,? Lane County District No. 1 Fire Chief Terry Ney said of the victims. The small plane ?for whatever reason didn?t clear the woods,? Ney said.

Nearby resident Debbie Parker told the newspaper she had just gotten home Saturday afternoon and was unloading groceries when she heard the plane overhead.

?Didn?t sound real strong,? Parker said, sitting on her deck. ?And then I heard it crash.?

Some people associated with the nearby Oregon Country Fair property came by Saturday and thought the crash victims might be associated with the fair, she added.

Islamist Morsy wins Egyptian presidency with 52 percent

CAIRO (Reuters) - Islamist Mohamed Morsy of the Muslim Brotherhood was declared Egypt's first democratic president on Sunday by the state election committee, which said he had defeated former general Ahmed Shafik with 51.7 percent of last weekend's run-off vote.

He succeeds Hosni Mubarak, who was overthrown 16 months ago after a popular uprising. The military council which has ruled the biggest Arab nation since then has this month curbed the powers of the presidency, meaning the head of state will have to work closely with the army on a planned democratic constitution.

Thousands of Brotherhood supporters burst into cheers on Cairo's Tahrir Square, waving national flags, setting off fireworks and chanting "Allahu Akbar!" or God is Great, greeting a dramatic victory, tempered by the army's continuing role.

"Say! Don't fear! The military must go!" crowds chanted.

For Morsy, a U.S.-educated engineer who spent time in jail under Mubarak, a spokesman said: "This is a testament to the resolve of the Egyptian people to make their voice heard."

Shafik, a former air force commander and Mubarak's last prime minister, offered no immediate reaction. He has said he would offer to serve in a Morsy administration.

Morsy, 60, won the first round ballot in May with a little under a quarter of the vote. He has pledged to form an inclusive government to appeal to the many Egyptians, including a large Christian minority, who are anxious over religious rule.

The military council will retain control of the biggest army in the Middle East, whose closest ally is the United States. Morsy has said he will respect international treaties, notably that signed with Israel in 1979, on which much U.S. aid depends.

"President Morsy will struggle to control the levers of state," Elijah Zarwan, senior policy fellow at the European Council on Foreign Relations, said in Cairo.

"He will likely face foot-dragging and perhaps outright attempts to undermine his initiatives from key institutions. Faced with such resistance, frustration may tempt him to fall into the trap of attempting to throw his new weight around," Zarwan told Reuters. "This would be a mistake.

"His challenge is to lead a bitterly divided, fearful, and angry population toward a peaceful democratic outcome, without becoming a reviled scapegoat for continued military rule."

LIMITED POWERS

Morsy will not enjoy the extent of modern, pharaonic powers exercised by Mubarak: those have been curtailed by a military establishment which will decide just how much he will be able to do in government. The Brotherhood had said it would press on with protests against the army's latest rulings.

Still, his victory in the country's first free presidential election breaks a tradition of domination by men from the armed forces, which have provided every Egyptian leader since the overthrow of the monarchy 60 years ago, and installs in office a group that drew on 84 years of disciplined grassroots activism to catapult Morsy into the presidency.

He has promised a moderate, modern Islamist agenda to steer Egypt into a new democratic era where autocracy will be replaced by transparent government that respects human rights and revives the fortunes of a powerful Arab state long in decline. Morsy is promising an "Egyptian renaissance with an Islamic foundation".

Yet the stocky, bespectacled party official, appears something of an accidental president: he was only flung into the race at the last moment by the disqualification on a technicality of Khairat al-Shater, the group's preferred choice.

With a stiff and formal style, Morsy, who has a doctorate from the University of Southern California, cast himself as a reluctant latecomer to the race, who cited religious fear of judgment day as one of his reasons for running. He struggled to shake off his label as the Brotherhood's "spare tire".

Questions remain over the extent to which Morsy will operate independently of other Brotherhood leaders once in office: his manifesto was drawn up by the group's policymakers. The role Shater might play has been one focus of debate in Egypt.

"I will treat everyone equally and be a servant of the Egyptian people," Morsy said at his campaign headquarters in Cairo shortly after polling ended last Sunday, a week before his victory was confirmed by the Mubarak-era judicial body overseeing the vote.

But many Egyptians, not least the Christian minority, remain suspicious of Morsy and even more so of the group he represents. Anti-Brotherhood sentiment, fuelled by both a hostile media and some of the group's policies, has soared in recent weeks.
